Terms of Service — FundayDrive

These Terms of Service ("Terms") govern your use of the FundayDrive mobile app and website (the "Service"), operated by K & K Concepts, LLC, an Arizona limited liability company ("we," "us," "our"). By creating an account or purchasing a rally, you agree to these Terms.

1. The Service

FundayDrive sells self-guided driving rally experiences. Each rally provides written turn-by-turn directions, clues, and questions along a route, with mileage tracked from the odometer readings you enter. Rallies are intended to be played by a group with a designated navigator handling the app and a driver focused solely on driving — see our Liability Waiver for details on this requirement.

2. Accounts

You must provide accurate information when registering and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Purchases, Refunds & No Expiration

Rallies are sold as one-time digital purchases granting access to a specific route.
Payments are processed by Stripe; we do not store your card details.
No expiration. Purchased rallies never expire. There is no deadline to complete your rally — play it this weekend or next year.
Refunds. A full refund may be requested within 30 days of purchase, provided the rally session has not been started in the app. Once a session has begun, the purchase is considered used and is non-refundable, except where the rally content is materially defective (at our discretion).
Plans changed? Because purchased rallies never expire, we encourage you to hold your purchase and schedule your rally for another date rather than requesting a refund.

4. Acceptable Use

You agree not to misuse the Service, including attempting to bypass payment for content, sharing access codes for purchased rallies beyond your own group/team, or using the Service in a manner that violates traffic laws or endangers yourself or others.

5. Assumption of Risk & Liability

Use of the Service while driving carries inherent risk. Your acceptance of our separate Liability Waiver is required before purchasing a rally, and its terms are incorporated into these Terms by reference. To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, and K & K Concepts, LLC disclaims liability for indirect, incidental, or consequential damages arising from use of the Service.

6. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time as described in our Privacy Policy.

7. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

8. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.

9. User-Generated Content & Sharing

FundayDrive includes an optional feature that lets you take or select photos and share them through your device's native share sheet to third-party platforms (e.g., Instagram, Facebook, WhatsApp). By using this feature, you agree to the following:

Your content, your responsibility. You are solely responsible for any content you capture or share. You must own or have the right to share any photo you post.
Third-party platforms. Content shared to external platforms is governed by those platforms' terms of service and privacy policies. We are not responsible for how third parties handle your content once shared.
Featured content. If you enable the "Allow FundayDrive to feature my photos" toggle, you grant K & K Concepts, LLC a non-exclusive, royalty-free license to display and re-post publicly available content you have tagged with #FundayDrive. You may withdraw this consent at any time by emailing support@fundaydrive.com.
No objectionable content. You may not share content that is unlawful, defamatory, threatening, or otherwise objectionable. We reserve the right to decline to feature content at our discretion.
